The arbitration will be conducted by a neutral arbitrator through the American Arbitration Association or a similar service chosen by the parties. The arbitrator’s decision shall be final, and judgment may be entered in any court with jurisdiction. Both parties agree that they will resolve any disputes under these Terms individually, without class or representative actions. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

All disputes and claims under these Terms must be resolved on an individual basis. Class arbitrations, class actions, and representative actions are not permitted. Each party may only bring claims in their individual capacity and not as a plaintiff or class member in any class or representative action.

Liability Disclaimer

Queen City Towing and its suppliers may make improvements and changes to the Site at any time. All information, software, products, and services on the Site are provided "as is" without warranty or condition of any kind. To the maximum extent permitted by law, Queen City Towing disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Queen City Towing and its suppliers will not be liable for any direct, indirect, punitive, incidental, special, consequential, or other damages arising out of or in any way connected with the use or performance of the Site. To the maximum extent permitted by law, this agreement is governed by the laws of the State of North Carolina, and you consent to the exclusive jurisdiction and venue of courts in North Carolina for all disputes arising out of or related to the use of the Site.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Queen City Towing as a result of this agreement or use of the Site. Queen City Towing's compliance with governmental, court, and law enforcement requests or legal processes is not in derogation of this agreement. If any part of this agreement is found to be invalid or unenforceable under applicable law, the invalid provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement will remain in effect.
